1 Booking and Service Fee
1.1 The person receiving this invoice (“client”) agrees to all the terms and conditions of this service agreement upon payment of the booking fee in the manner set out in paragraph 1.2 below. In the event that more than one person requires the services of Lush Looks (“LL”), the client agrees to all the terms and conditions of this service agreement on behalf of all such persons (“Additional Clients”).
1.2 Subject to paragraphs 1.5 and 1.6, booking of the services of LL will be confirmed upon the receipt by LL of an initial non-refundable and non-transferable deposit of 50% of the total service fee as indicated in this invoice, by way of bank transfer or PayLah!/PayNow within the deadline mentioned in paragraph 1.2.
1.3 The deadline referred to in paragraph 1.2 is 48 hours from the time this invoice is sent by LL to the prospective client.
1.4 For the avoidance of doubt, booking will only be confirmed after payment of the booking fee mentioned in paragraph 1.2. Priority of booking is determined by LL based on the time of receipt of the booking fee.
1.5 Subject to paragraph 1.6, booking of LL’s services must be confirmed in the manner set out in paragraph 1.2 more than 3 days prior to the date that the services of LL is required (“Service Date”).
1.6 The client may make a booking for the services of LL at a time which is 3 days or less to the Service Date if the client make a payment of the service fee in full in the manner set out in paragraph 1.2.
1.7 Full balance of the service fee must be paid and received by LL at least 1 day before the Service Date. LL reserves the right not to provide the services on your wedding day or the Service Date if there is any failure to make payment of the full service fee by such deadline.
2 Cancellation Policy
2.1 There shall not be any changes made to the arrangements made in relation to LL’s services after the time which is 24 hours prior to the agreed time of provision of services by LL on the Service Date.
2.2 LL will provide a recommendation for a replacement make-up artist if the relevant make-up artist cannot can no longer provide the services due to unforseen circumstances. The acceptance of the replacement make-up-artist is at the sole and absolute discretion of the client.
2.3 LL reserves the right to terminate this contract at any time for any non-compliance of any term of this agreement by the client or Additional Clients, or if there is any cause for refusal of services, including but not limited to, the use of threats and abusive language or behavior by the client or Additional Clients.
2.4 LL reserves the right to terminate this contract at any time for any non-compliance of any term of this agreement by the client or Additional Clients, or if there is any cause for refusal of services, including but not limited to, discrepancy in the service engaged by the client or Additional Clients. For example, booking made for makeup and hair services for events when it is actually for bridal makeup and hair services.
2.4 All monies paid to LL are non-refundable after LL has exercised the right to terminate this contract pursuant to paragraph 2.3.
2.5 Cancellation of LL’s services by the client shall be notified to LL at least 24 hours prior to the Service Date. All monies paid to LL are non-refundable after the services are cancelled by the client.
2.6 Any legal liability of LL, its employees or its agents to the client or Additional Clients is limited only to the service or booking fee that is paid to LL.
3 Booking Arrangements
3.1 The booking timings and the services to be provided by LL are subject to agreement between the client and LL in writing, including the time that the services of LL will commence and end on the Service Date. For guidance, the estimated time taken for the completion of make-up done on one person is between 60 to 180 minutes.
3.2 Booking of the services of LL is subject to the following terms and conditions:
- any additional services required by the client which were not previously agreed by the client pursuant to paragraph 3.1 will only be provided at the sole and absolute discretion of LL and at an additional fee (if any);
- the client and all Additional Clients shall be present at the agreed location and time for provision of the services;
- the client and all Additional Clients shall be physically present at the same location;
- there shall not be any gaps in timings between the provision of services by LL to any one person.
3.3 The client may request for a change in the Service Date and booking timings on the Services Date. However, any changes are subject to the make-up artist’s availability and there shall be no refund of any monies paid to LL if the make-up artist is not available on the new date or timings requested by the client.
3.4 There shall not be any deduction to the number of persons in the bridal party who will require make-up services provided by LL. For the avoidance of doubt, the client may request for additional persons in the bridal party who require make-up services provided by LL.
4 Performance of services
4.1 The client and all persons who require LL’s services shall be punctual for the appointment on the Service Date and shall cooperate fully with the make-up artist during the appointment in order to ensure that the make-up services can be completed by the agreed end time on the Service Date.
4.2 LL shall not be liable for failure to provide the services by the agreed end time if the failure is caused by the client or person requiring LL’s services due to a breach of paragraph 1.1 or for any reason whatsoever.
4.3 If the client and persons who require LL’s services do not comply with paragraph 1.1, the make-up artist is entitled to terminate the provision of services at the agreed end-time on the Service Date notwithstanding that the services provided by LL are incomplete at the agreed end time.
5.1 Any skin condition and allergy of the client and Additional Clients shall be reported to the make-up artist prior to the application of any make-up by the make-up artist. LL shall not be liable for any damages to the client or Additional Clients caused by the application of make-up if no prior warning was given to the make-up artist.
5.2 If necessary, the client and Additional Clients may request for a sample skin test of the make-up product for the purpose of determining whether there will be an immediate skin reaction to the make-up product.
5.3 All brushes, tools and makeup products are kept sanitary and are sanitized between every makeup session.
5.4 LL shall not be liable for any medical complications arising from any adverse allergic reaction to the brushes, tools and makeup produces used by the make-up artist.
6 Personal Data
6.1 You agree to the taking of photographs (including but not limited to photographs of the client or Additional Clients before and after the make-up applications) and video footage of make-up applications by LL for LL’s internal records.
6.2 The photographs and video footage mentioned in paragraph 6.1 may be used by LL for marketing and promotional purposes after obtaining consent from the client and Additional Clients.
